This privacy notice for Choice Living Solutions, LLC, a Texas limited liability company doing business as Austin Apartment Locators Group (“we,” “us,” or “our”), brokered by Spirit Real Estate (TREC License #562021-B), describes how and why we collect, store, use, and share (“process”) your information when you use our services (“Services”), such as when you:

- Engage with us in other related ways, including apartment locating, leasing, sales, relocation assistance, or events

SUMMARY OF KEY POINTS
What personal information do we process? We process the information you provide when you contact us about an apartment search, including your name, contact information, rental preferences, and information you choose to share about your rental or financial background. We also collect certain technical information automatically when you visit our website.
Do we process sensitive personal information? We collect financial and background information you provide in connection with your rental inquiry, including what you tell us about your income, credit, rental history, and background. Under Texas law this is not classified as “sensitive personal data,” though some other states treat certain financial information as sensitive. We do not intentionally collect information about your race, ethnicity, religion, health, sexual orientation, immigration status, or biometric data, and we do not collect or process any information for the purpose of inferring characteristics about you.
Do we share your information with apartment communities? Yes, but only for communities you select. When you mark a community as a favorite or ask us to register you there, we forward the information you provided to us — including what you told us about your rental history, credit, background, and income — so that community can respond to you and credit us as your locator. Those communities are independent businesses that may contact you directly.
Do we sell your information? We do not sell the information you provide on our forms. When we send your information to an apartment community, it is because you selected that community. We do use advertising and analytics services such as Google, Meta, and TikTok that may be treated as a “sale” or “sharing” of online identifiers under some state laws, and you can limit this through your browser and those platforms’ ad settings — see Section 10. We never share text message opt-in data or SMS consent with any third party for that party’s marketing purposes.
Do we collect information from third parties? We may collect information from public databases, marketing partners, social media platforms, and other outside sources.
Do you use automated or AI systems? Yes. Some of our calls, text messages, and emails are generated or assisted by automated or AI systems. These may not reflect current apartment availability, pricing, or community policies. Verify critical details directly with apartment communities before making decisions.
Are calls recorded? Calls to and from us, including calls handled by an AI assistant, may be monitored or recorded. Where required by law, you will be notified at the beginning of the call.
How do we keep your information safe? We use organizational and technical safeguards. No transmission over the internet or storage technology can be guaranteed to be completely secure.
What are your rights? Depending on where you live, you may have rights to access, correct, delete, or obtain a copy of your personal information, and to opt out of certain processing.
How do you exercise your rights? Submit a data subject access request or contact us at help@austinapartmentlocators.com.
1. WHAT INFORMATION DO WE COLLECT?
Personal information you disclose to us
In short: we collect personal information that you provide to us.
We collect personal information that you voluntarily provide when you contact us, fill out a form, express interest in our Services, or otherwise communicate with us. What we collect depends on how you interact with us and what you choose to share. It may include:
- Names
- Phone numbers
- Email addresses
- Mailing addresses
- Contact preferences
- Apartment budget and preferences
- Preferred move date
- Rental history
- Stated income
- Information you choose to share about credit history or background history
Sensitive information. With your consent or as permitted by law, we may process financial information and background history information that you provide in connection with your rental inquiry.
All personal information you provide must be true, complete, and accurate, and you must notify us of any changes.
We do not intentionally collect Social Security numbers, financial account numbers, or health information. If you choose to provide such information in connection with your apartment inquiry, we will use it only as necessary to assist with your request and will not disclose it except as required by law.
Call recording
All calls to and from us are recorded, including calls you place to us, calls placed by our team, and calls handled by our AI assistant. We record for quality, training, and recordkeeping purposes. By calling us, or by continuing a call from us, you consent to that recording. If you do not want to be recorded, do not call us, end the call, and do not use our Services. We do not create or store voiceprints or other biometric identifiers from your voice.
Information automatically collected
In short: some information — such as your IP address and browser characteristics — is collected automatically when you visit our Services.
This information does not reveal your specific identity but may include device and usage information. It is primarily used to maintain the security and operation of our Services and for internal analytics and reporting.
- Log and usage data. Service-related, diagnostic, usage, and performance information our servers collect in log files, including IP address, device information, browser type and settings, date and time stamps, pages and files viewed, searches, and error reports.
- Device data. Information about the computer, phone, or tablet you use to access the Services, including IP address, device and application identifiers, browser type, hardware model, internet service provider or mobile carrier, operating system, and system configuration.
- Location data. Information about your device’s location, which may be precise or imprecise depending on your device type and settings. You can opt out by disabling location access on your device, though some features may not work.
We also collect information through cookies and similar technologies. See Section 5.
Information collected through third-party listing and search tools
We deliver apartment lists to you through third-party listing and search platforms that we subscribe to and provide access to. When you open a list, browse properties, or mark a community as a favorite in one of these tools, the platform collects information about your activity, which may include the properties you view and save, the date and time of your activity, your IP address, and device information. We receive notifications from these platforms about the communities you favorite or save, and we retain a record of those events.
These platforms are operated by companies we do not own or control. They are governed by their own terms and privacy notices, and we are not responsible for how they collect, use, or retain your information. We encourage you to review their policies.
Link tracking
Links we send you by text message or email may be shortened, branded, or routed through a link management service before reaching their destination. When you click one of these links, we may collect the date and time of the click, the link clicked, your IP address, and device and browser information. We use this to understand which properties and messages you engage with and to follow up appropriately.
Information collected from other sources
In short: we may collect limited data from public databases, marketing partners, and other outside sources.
To improve our ability to provide relevant services and to update our records, we may obtain information about you from public databases, joint marketing partners, affiliate programs, data providers, and other third parties. This may include mailing addresses, email addresses, phone numbers, intent data, IP addresses, social media profiles, and custom profiles.
Use of AI and automated communications
We use automated and AI-assisted systems to generate or assist with calls, text messages, and emails, including initial follow-ups, delivery of apartment suggestions, form responses, and ongoing support related to your inquiry.
We may use information you provide to improve these tools, including our response handling, suggestions, and follow-ups. We handle this information securely and in accordance with this notice, and we do not sell it or use it outside the scope of apartment locating services.
2. HOW DO WE PROCESS YOUR INFORMATION?
In short: we process your information to provide and improve our Services, communicate with you, prevent fraud, and comply with law.
We process your personal information to:
- Deliver our apartment locating services and respond to your inquiries
- Register your inquiry with apartment communities you select
- Communicate with you by phone, text, and email about your apartment search
- Send administrative information, including changes to our terms and policies
- Send marketing and promotional communications, consistent with your preferences and consent
- Deliver targeted advertising, where permitted
- Request and post testimonials
- Protect our Services, including fraud monitoring and prevention
- Evaluate and improve our Services, products, marketing, and your experience
- Identify usage trends and measure the effectiveness of our campaigns
- Improve our automated and AI-assisted systems
- Comply with legal obligations, respond to legal requests, and establish, exercise, or defend legal claims
Consent and communication records. We maintain records of your consents, any opt-out or revocation requests, message history, and communication logs, including those generated by AI systems, to comply with applicable law and to demonstrate proof of consent if needed. See Section 6 for how long we keep these.
3. WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?
In short: we share information in the specific situations described below.
Apartment communities you select
We forward the information you provide to us to the apartment communities you select or mark as a favorite, so those communities can register your inquiry, credit us as your locator, and respond to you. We do not send your information to every community on a list we prepare for you — only those you choose.
Why we share this and how we are paid. Our locating service is free to you because apartment communities pay a referral fee to our sponsoring broker when we register you as our client and you lease there. Registering you requires providing the community with your contact information. Without that, the community will not credit us, and we cannot provide the service at no cost to you.
When you mark a community as a favorite or save it in a listing tool we provide, request a tour, or ask us to register you, you authorize this sharing and you agree that the community may contact you directly by telephone call, text message, and email about its properties, including using automated technology or an artificial or prerecorded voice.
What we send. We forward the information you provide to us to the apartment communities you select, including what you tell us about your rental history, credit, background, and income. Our registration to a community — sometimes called a guest card — also includes your name, telephone number, email address, desired move-in date, the number of bedrooms and bathrooms you are looking for, your stated budget range, the city or area you are searching in, and our locator registration information.
We share this information to help identify communities whose published qualification criteria may match your situation and to reduce the chance that you spend time touring or applying at a community that would not approve you. You are not required to provide any of this information to use our Services. If you prefer that we not share a particular item, tell us before you select a community and we will not include it.
What we do not do. We do not obtain a credit report, criminal background report, or tenant screening report about you, and we do not verify the information you give us. We share only what you tell us. We do not represent to any community that you are qualified or approved.
Communities conduct their own screening and will request and verify whatever information they require directly from you when you apply. Any decision about your application is made by the community, not by us.
Apartment communities are independent businesses that we do not own or control. They may contact you directly by phone, text, or email, and they maintain their own privacy practices and communication policies. To stop communications from a particular community, you must contact that community directly — opting out with us does not opt you out with them.
You may withdraw your authorization to share your information with additional communities at any time by contacting us. Withdrawal is prospective only and does not affect information already shared.
On request, we will tell you which communities received your information and when.
Third-party service providers
We share information with service providers that help us deliver our Services, including apartment listing and search platforms, SMS and telephony platforms, link management services, apartment data providers, customer relationship management tools, automated and AI communication tools, and utility connection services. These providers may use your information only to perform services for us.
Compensated referrals to other services. From time to time we may refer you to third-party services related to your move, such as utility connection services, insurance providers, movers, or licensed healthcare providers who evaluate requests for assistance or emotional support animals. When you use our utility concierge service, your contact information is shared with our utility partners to set up your service. For other referrals, we may provide you a link or discount code rather than sharing your information directly.
We may receive compensation when you sign up for or purchase a service through one of our referrals. This compensation does not affect the rates, pricing, or services available to you. You are never required to use a service we refer you to, and declining will not affect the apartment locating services we provide. Any service we refer you to is an independent business that we do not own or control, and we are not responsible for the services it provides or the outcome of any evaluation, application, or documentation it may issue.
Google Maps Platform
We may share information with certain Google Maps Platform APIs, including the Maps API and Places API. We obtain and store your location on your device. You may revoke your consent at any time by contacting us.
Business transfers
We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business.
Legal requirements
We may disclose your information where required to do so by law, or where we believe disclosure is necessary to comply with legal process, protect our rights or property, prevent fraud, or protect the safety of any person.
Text message opt-in data — excluded from all sharing
We do not share, sell, or transfer text message originator opt-in data or SMS consent to any third party or affiliate for marketing or promotional purposes. This category is excluded from all sharing described in this section.
Advertising and analytics partners
We work with advertising and analytics platforms — including Google, Meta, TikTok, and similar services — that use cookies, pixels, and similar tracking technologies on our website. These technologies allow us to measure how our website performs and to show you our ads on other websites and apps after you visit us. This is sometimes called targeted advertising, cross-context behavioral advertising, or retargeting.
Information shared with these platforms is generally limited to online identifiers and activity, such as your IP address, device and browser information, and the pages you viewed. We do not provide these platforms with what you tell us about your rental history, credit, background, or income.
Under some state privacy laws, this activity may be treated as a “sale” or “sharing” of personal information. Section 10 explains how to limit interest-based advertising through your browser settings and through each platform’s own ad preference controls.
Categories of third parties we disclose information to
- Apartment communities and their management companies that you select
- Service providers that operate our website, forms, messaging, telephony, listing and search, link management, and customer relationship tools
- Automated and AI communication providers
- Utility connection partners and other services we refer you to
- Advertising, retargeting, and analytics providers
- Professional advisors, and legal or regulatory authorities where required
- A successor entity in connection with a merger, financing, or sale of our business
Sharing with apartment communities is at your direction
We do not sell the information you provide to us on our forms. When we send your information to an apartment community, we do so because you selected that community — by marking it as a favorite, requesting a tour, or asking us to register you there. Disclosures made at your direction are not a “sale” of personal information under applicable state privacy laws.
Accuracy of AI responses
Some of our communications may be generated or assisted by AI systems. While we work to be accurate, these responses may not reflect current apartment availability, pricing, or community policies. Verify critical details directly with apartment communities before making final decisions.
4. WHAT IS OUR STANCE ON THIRD-PARTY WEBSITES?
In short: we are not responsible for the safety of information you share with third parties that we link to or that advertise on our Services.
The Services may link to third-party websites, online services, or mobile applications, and may contain advertisements from third parties that are not affiliated with us. We make no guarantee regarding those third parties and will not be liable for any loss or damage caused by their use. Inclusion of a link does not imply endorsement.
We cannot guarantee the safety and privacy of data you provide to third parties. Data collected by third parties is not covered by this notice. Review the policies of those third parties and contact them directly with questions.
5. DO WE USE COOKIES AND OTHER TRACKING TECHNOLOGIES?
In short: we may use cookies and similar technologies to collect and store your information.
We use cookies and similar tracking technologies, including web beacons and pixels, to gather information when you interact with our Services. Some of these help maintain security, prevent crashes, fix bugs, save your preferences, and support basic site functions.
We also permit third parties and service providers to use tracking technologies on our Services for analytics and advertising, including to manage and display advertisements and to tailor advertisements to your interests. These may appear on our Services or on other websites.
To the extent these technologies are deemed a “sale” or “sharing” — which includes targeted advertising as defined under applicable law — Section 10 explains the options available to you.
6. HOW LONG DO WE KEEP YOUR INFORMATION?
In short: we keep your information only as long as necessary, except for consent and communication records, which we keep for at least five years.
We keep your personal information only as long as necessary for the purposes described in this notice, unless a longer period is required or permitted by law.
We retain records of your consent to be contacted, any revocation or opt-out request, and the associated communication logs for at least five (5) years, and longer where necessary to comply with applicable law or to establish, exercise, or defend legal claims. We retain these records even after you ask us to delete other information, and even after your relationship with us ends. This retention is required for compliance with telephone and text messaging laws.
When we no longer have a legitimate business or legal need to process your other personal information, we will delete or anonymize it, or, where that is not possible because it is held in backup archives, securely store it and isolate it from further processing until deletion is possible.
7. HOW DO WE KEEP YOUR INFORMATION SAFE?
In short: we protect your personal information through organizational and technical security measures.
We have implemented appropriate and reasonable technical and organizational security measures designed to protect the personal information we process. However, despite our safeguards, no electronic transmission over the internet or information storage technology can be guaranteed to be completely secure. We cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not defeat our security and improperly collect, access, steal, or modify your information.
Transmission of personal information to and from our Services is at your own risk. Access the Services only within a secure environment.
8. DO WE COLLECT INFORMATION FROM MINORS?
In short: we do not knowingly collect data from or market to children under 18.
We do not knowingly collect, solicit data from, or market to children under 18 years of age, nor do we knowingly sell such personal information. By using the Services, you represent that you are at least 18, or that you are the parent or guardian of a minor and consent to that minor’s use of the Services.
If we learn that we have collected personal information from a user under 18, we will deactivate the account and take reasonable measures to promptly delete the data. If you become aware of any data we may have collected from a child under 18, contact us at help@austinapartmentlocators.com.
9. WHAT ARE YOUR PRIVACY RIGHTS?
In short: you may review, change, or terminate your account at any time, depending on your state of residence.
Withdrawing your consent. If we rely on your consent to process your personal information, you may withdraw that consent at any time by contacting us using the details in Section 13. Withdrawal does not affect the lawfulness of processing before withdrawal, nor processing conducted in reliance on other lawful grounds.
Opting out of calls, texts, and marketing communications. You may revoke consent to receive calls and text messages at any time, by any reasonable means. Replying STOP, QUIT, END, CANCEL, UNSUBSCRIBE, REVOKE, or OPT OUT to any text message will work, and you are not limited to those words. You may also tell us during a call, reply to any message in your own words, click the unsubscribe link in our emails, email us at help@austinapartmentlocators.com, or write to us at the address in Section 13.
We honor revocation requests promptly and in no event later than ten (10) business days. We may still send you service-related messages necessary to respond to your requests.
Note: revoking consent with us does not stop communications from apartment communities you previously selected. Contact those communities directly.
Account information. To review, change, or terminate your account, contact us at help@austinapartmentlocators.com. On request, we will deactivate or delete your account and information from our active databases, except for the consent and communication records described in Section 6, which we retain to prevent fraud, assist with investigations, enforce our legal terms, and comply with applicable legal requirements.
Cookies and similar technologies. Most browsers accept cookies by default. You can usually set your browser to remove or reject cookies, though this may affect certain features. You may also opt out of interest-based advertising.

10. CONTROLS FOR TRACKING PREFERENCES
Browser signals. Most browsers and some mobile operating systems include a Do-Not-Track (“DNT”) feature, and some browsers and extensions send a Global Privacy Control (“GPC”) signal. We do not currently respond to DNT or GPC signals, and we do not currently offer cookie preference controls on our website. If we become required to respond to these signals, we will update this notice. California law requires us to disclose how we respond to DNT signals, and this paragraph is that disclosure.
How to limit interest-based advertising. You can limit interest-based advertising directly through your browser and through each platform:
- Google: adjust your settings at Google Ads Settings and My Ad Center
- Meta (Facebook and Instagram): adjust your settings under Ad Preferences in your account
- TikTok: adjust your settings under Ads and Data in your account privacy settings
- Multiple advertisers at once: use the Digital Advertising Alliance tool at optout.aboutads.info or the Network Advertising Initiative tool at optout.networkadvertising.org
- Your browser: most browsers let you block or delete cookies, and some offer built-in tracking protection. Blocking cookies may affect how parts of our website work.

11. DO UNITED STATES RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?
In short: if you are a resident of certain states, you may have rights to access, correct, delete, or obtain a copy of your personal information, and to withdraw consent.
Residents of California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Montana, New Hampshire, New Jersey, Oregon, Tennessee, Texas, Utah, and Virginia may have the rights described below. These rights may be limited in some circumstances by applicable law.

Category L reflects only the financial information you provide in connection with your rental inquiry, which is treated as sensitive personal information under the law of some states, including California. We do not collect driver’s license or state ID numbers, passport numbers, account login credentials, precise geolocation, biometric identifiers, or information about your racial or ethnic origin, religious beliefs, health, sexual orientation, or immigration status.
Our forms do not ask about protected characteristics such as race, national origin, religion, disability, or familial status, and we do not use any such information to decide which communities to show you. You may choose to mention personal circumstances when you talk with us — for example, that you have children or need an accommodation for an assistance animal — and if you do, that information may appear in our communication records. We use it only to respond to what you asked us about.
Where we collect information that is treated as sensitive personal information under the law of your state, we do so only with your consent or as otherwise allowed by law, and you may have the right to limit its use or disclosure. We do not sell sensitive personal information, and we do not collect or process it for the purpose of inferring characteristics about you.
We may also collect other personal information outside these categories when you interact with us in person, online, by phone, or by mail, including through our support channels, surveys or contests, and in the course of delivering our Services.
We retain collected personal information as needed to provide the Services, and we retain consent and communication records as described in Section 6.

Texas residents
We qualify as a small business under the Texas Data Privacy and Security Act and are exempt from most of its requirements. Even so, we will honor requests from Texas residents to access, correct, or delete the personal data we hold, and you may submit a request using the methods described below.
We collect financial and background information where you provide it in connection with your rental inquiry. Under the Texas Data Privacy and Security Act, financial and background information of this kind is not classified as “sensitive personal data.”
We do not collect biometric identifiers. Our AI phone assistant does not create or store voiceprints. We do not collect or sell sensitive personal data as that term is defined under Texas law, and we do not sell the information you provide on our forms.
We do process personal data for targeted advertising through services such as Google, Meta, and TikTok. Section 10 explains how to limit this through your browser and through each platform’s own ad settings, and you may also contact us using the details in Section 13.
How to exercise your rights
Submit a data subject access request, visit our contact page, or use the contact details in Section 13.
Under certain state laws you may designate an authorized agent to make a request on your behalf. We may deny a request from an agent who does not provide proof of valid authorization.
Request verification
We will need to verify your identity before responding. We will use the personal information in your request only to verify your identity or authority. If we cannot verify you from information we already maintain, we may request additional information for verification and fraud prevention.
Appeals
If we decline to act on your request, you may appeal by emailing help@austinapartmentlocators.com. We will inform you in writing of any action taken or not taken, including a written explanation. If your appeal is denied, you may submit a complaint to your state attorney general.
California “Shine the Light” law
California Civil Code Section 1798.83 permits California residents to request, once a year and free of charge, information about categories of personal information we disclosed to third parties for direct marketing purposes and the names and addresses of those third parties in the preceding calendar year. Submit requests in writing using the details in Section 13.
12. DO WE MAKE UPDATES TO THIS NOTICE?
In short: yes, we update this notice as necessary to stay compliant with relevant laws.
We may update this privacy notice from time to time. The updated version will be indicated by a revised “Last updated” date. If we make material changes, we may notify you by prominently posting a notice or by sending you a direct notification. We encourage you to review this notice periodically.

14. HOW CAN YOU REVIEW, UPDATE, OR DELETE THE DATA WE COLLECT FROM YOU?
Depending on the laws of your state of residence, you may have the right to request access to the personal information we collect from you, details about how we have processed it, correction of inaccuracies, or deletion of your personal information. You may also have the right to withdraw your consent to our processing. These rights may be limited in some circumstances by applicable law.
To request to review, update, or delete your personal information, submit a data subject access request.
Note that consent and communication records described in Section 6 are retained for legal compliance and defense purposes and are not deleted on request.
